Judge Rules on Expert Witness in R. Kelly Court Case

Chicago Circuit Court Judge Vincent Gaughan ruled last Friday in the R. Kelly case that prosecutors won't be allowed to have an expert testify that child victims of sexual abuse sometimes deny the abuse ever happened. The doctor was to testify that underage victims of pornography often respond to the trauma by delaying a cry for help.

The doctor was to testify that underage victims of pornography often respond to the trauma by delaying a cry for help. However, the judge stated the alleged victim never has made a "delayed outcry" or any "outcry" in this case - and in fact has denied she was the child on the tape.

Kelly was charged in 2002 after a tape was leaked of him having sex and peeing on a 14 year old female.  Footage of the video leaked to the Internet.  Kelly has pleaded not guilty! The alleged victim has always denied that she is the girl in the tape.      

The Judge Gaughan also ruled Friday that prosecutors may allow another expert to testify that the girl in the videotape appears to be underage.  The judge also scheduled a Dec. 18 hearing on whether a medical doctor can testify that the vein pattern on Kelly's hands matches that of the man in the videotape.
